2.0 Access to the Services
(a) Changes to Services: The Services may change as the Company refines or adds new marketing and lead-generation tools. We reserve the right to modify or discontinue any part of the Services without prior notice.
(b) Creating an Account: You promise to provide accurate, complete, and updated information. All personal information provided is governed by our Privacy Policy.
(c) Account Responsibilities: You are responsible for maintaining password security and all activities associated with your account.
(d) Reasonable Use Policy: Our unlimited marketing, call tracking, and support offerings are subject to a Reasonable Use Policy to ensure quality of service for all contractor partners.
(e) AI Feature Availability & Use: AI Features are subject to rate limiting, third-party provider terms, and reasonable usage thresholds.
3.0 Policy for Using the Services
You agree not to engage in any of the following prohibited activities:
- No Violation of Laws: Violate any federal, state, or local laws, privacy rights, or contractual obligations.
- No Unsolicited Spam: Send unauthorized marketing, spam, or misleading homeowner communications.
- No Scraping or Reverse Engineering: Copy, scrape, mine data, or reverse engineer any part of our platform or proprietary SEO frameworks.
- AI Acceptable Use: Comply with all applicable regulations (including TCPA and CAN-SPAM) when deploying AI call/chat tools, and maintain appropriate human oversight over AI Outputs.
4.0 Terms & Conditions of Sale
By submitting an order or signing a contractor growth proposal, you agree to pay the specified setup fees, monthly marketing campaign investments, and applicable taxes. All payments are processed securely through verified third-party payment merchants.
5.0 Subscriptions, Cancellations & Refunds
5.1 Recurring Subscriptions: Ongoing SEO, Google Ads management, and lead tracking subscriptions automatically renew on your billing date unless cancelled in accordance with your agreement.
5.5 Cancellation Notice: Subscriptions may be cancelled by submitting formal notice to our billing team prior to your next renewal date.
5.9 Digital Deliverables & Services: Digital courses, snapshots, strategy plans, and custom audits are considered delivered upon login or delivery of initial calls.
6.0 Intellectual Property Rights
All materials, brand assets, software, content, templates, and proprietary marketing playbooks on the website and within our services are owned by Contractor Flow Marketing Group or its licensors. You are granted a limited, non-exclusive license to utilize these resources strictly for your contractor business operations.
7.0 User Content & Feedback
You retain ownership of any media, project photos, customer testimonials, and campaign inputs you submit. You grant us a worldwide license to host and process such materials to deliver, run, and optimize your marketing campaigns.
8.0 — 12.0 Disclaimers & Limitation of Liability
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. CONTRACTOR FLOW MARKETING GROUP DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES.
13.0 — 15.0 Indemnification, Disputes & Governing Law
You agree to defend and indemnify Contractor Flow Marketing Group against any third-party claims resulting from your breach of this Agreement. All legal matters shall be governed by the laws of the United States.
